Alper.) <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on September 4 and September 11, 1998, <br /> a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 23, 1998, at 7:30 P.M., at which time the following members of <br /> the Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Robert G. Nelson, <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Jack E. Landers-Cauley represented the applicant stating that the proposal win <br /> be an improvement to the property with the demolition of the existing old structure and <br /> construction of a new three-bedroom dwefling. Installation of a Title V septic system is <br /> planned, as well as upgrade of utility service to the new construction. Mr. Landers-Cauley <br /> informed the Board that due to Conservation Commission concerns, the road leading to <br /> the property cannot be paved. However, the applicant intends to upgrade and maintain <br /> the condition of the road. Letters from an abutter and a neighbor expressed support of the <br /> proposed construction. <br />
