Board of Appeals Robert Eastwood SP-98-123 2 <br /> FINDINGS <br /> General <br /> 1. the subject property is located at 87 Hoophole Road and consists of four acres. <br /> Special Permit Criteria <br /> Section 174-17 of the Mashpec Zoning By-laws and Massachusetts General Law <br /> Chapter 40A, Chapter 6, require a finding that the extension, alteration or change shall not <br /> be substantially more detrimental to the neighborhood than the existing non-conforming <br /> use. <br /> Specific Findings <br /> 1. the proposed construction will be in the middle of the lot and will conform to <br /> the setback requirements. <br /> 2. the proposed construction will be farther from the wetlands than the existing <br /> structure. <br /> 3. there is adequate land area to provide sufficient parking. <br /> 4. the proposed changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded, the Board of Appeals voted unanimously on September 23, 1998 to grant <br /> the Special Permit with the following conditions: <br /> I. the road be upgraded to minimal standards of an impervious surface to ensure <br /> access for fire-fighting apparatus and safety vehicles and equipment. <br /> 2. the road be widened to a minimum width of 14 feet and a minimum vertical <br /> clearance of 13 feet six inches. <br /> 3. the road shall be maintained for these standards in perpetuity. <br /> 4. the house be constructed farther away from John's Pond. <br /> 5. a Title V septic system be installed. <br /> 6. a full set of plans with dimensions of the proposed construction be submitted. <br /> The permit is conditioned upon compliance with plans of I E. Landers-Cauley, <br /> PE. to be submitted for approval by the Zoning Board of Appeals, <br />
