Smith V-98-118 266 Monomoscoy Road <br /> Map 120 Block 57B <br /> A Petition was filed on August 5, 1998 by Thomas F. Smith of Cotuit, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for pern-dssion <br /> to vary the frontage setback requirements on property located in an R-3 zoning district at <br /> 266 Monomoscoy Road (Map 120 Block 57B)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on September 4 and September 11, 1998, <br /> a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 23, 1998, at 7:30 P.M., at which time the following members of <br /> the Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan IH and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> ItAr. Govoni moved to continue until October 14, 1998 Mr. Smith's requests for a <br /> Variance and Special Permit due to the fact that no plans were available for the Board to <br /> review. <br /> At the continued hearing on October 14, 1998 Mr. Govoni informed 1W. Smith <br /> that the Conservation Commission has to approve the location of the structure in order for <br /> the Board of Appeals to grant a Variance, He finther stated that the Conservation <br /> Commission has denied, with prejudice, Mr. Smith's case <br /> The Board received numerous phone calls from abutters in opposition to the <br /> project. <br />
