Smith V-98-118 2 <br /> FINDINGS <br /> General Findiggs <br /> I the subject property is located at 266 Monomoscoy Road and consists of <br /> 10,500 square feet <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner, <br /> Specific FindiW <br /> I. Mr. Smith failed to provide three sets of detailed plans of the garage along <br /> with the original signature of the Registered Engineer. <br /> 2. the subject property fronts on Great River and Mr. Smith failed to provide <br /> information on the impact of the project to the wetlands. <br /> 3. the Board cannot grant a Variance without approval of the location of the <br /> building from the Conservation Commission. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> fOed to meet the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Board of Appeals voted unanimously on October 14, 1998 to <br /> deny, without prejudice, W Smith's request for a Variance. <br />
