(Owner of record: Anthony J. LaCava, Tr.) <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on September 4 and September 11, 1998, <br /> a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 23, 1998, at 7:30 P.M., at which time the following members of <br /> the Board of Appeals were present and acting throughout: Edward M. Govoni, Robert. <br /> G. Nelson and James M. Dorgan I <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Kenneth Marsters represented the applicant, Anthony J. LaCava, Trustee. <br /> He stated that Great Hay Road was shifted approximately eight feet in order to remain on <br /> Mi. LaCava's property. This was done to avoid an issue over ownership between the <br /> Town and Mr. LaCava. When the road was relocated, approximately a total of 4000 <br /> square feet was removed from a comer of the lot. Mr. Marsters indicated that the <br /> Planning Board has seen the proposed plans. Mr. Allan Morris, an abutter, expressed <br /> concerns about headlights shining into his living room with the road being moved. Mr. <br /> Govoni stated that Town plans to complete the road will proceed regardless of the <br /> applicant's request for Special Permits. No other comments were received from abutters. <br />
