Cardillo V-98-117 194 Pin-Aico Pond Road <br /> Map 2 Block I I <br /> A Petition was filed on July 27, 1998 by Robert T. Cardillo of Forestdale, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to divide an existing lot into two buildable lots on property located in an R-5 zoning <br /> district at 194 Pimlico Pond Road (Map 2 Block 11) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on September 4 and September 11, 1998, <br /> a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 23, 1998, at 7:30 P.M., at which time the following members of <br /> the Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Robert G. Nelson <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represented the applicant and <br /> submitted the Cardillo's deed dated July 18, 1980. Unknown to the Cardillos, the two lots <br /> extended across Pimlico Pond Road which the Cardillos did not buy, thereby converting <br /> the two lots into one. Mrs. Cardillo stated that the land and the house have been owned by <br /> the family for 18 years and her daughter plans to construct a home on Lot I which will <br /> meet all the setback requirements. <br /> A letter from an abutter, Ms. Miriam S. Joseph, in opposition to the project was <br /> read. A resident, Donna McCaffery, stated she was opposed to granting a variance to <br /> subdivide the lot due to her concern about the nitrate levels in the Mashpee River. <br />
