All agreed. <br /> At the continued hearing on October 14, 1998, Mrs. Cardillo, her daughter Robin <br /> Mastandrea and son Robert Cardillo, Jr. represented the request for a Variance. Mr. <br /> Govoni referred to a nitrogen loading calculation sheet submitted by Cape& Islands <br /> Engineering which showed low levels of nitrogen loading for the parcels. <br /> FINDINGS <br /> Gene <br /> 1, the subject property is located at 194 Pimlico Pond Road and consists of 4.58 <br /> acres. <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the Permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> Specifi <br /> I. relief may be granted without detriment to the public good. <br /> 2. relief may be granted without derogating from the intent or purpose of the By- <br /> laws. <br /> 3. the subject property fronts on Wakeby Pond and is impacted by wetlands. <br /> 4. The lots meet the 80,000 square foot minimum requirement. <br /> 5. The nitrogen loading calculation indicate parts per million to be 1.3; well below <br /> the federal guidelines of 10.0 parts per million. <br /> 6. the house on Lot I Arill be constructed away from Wakeby Pond and meet all <br /> the setback requirements. <br /> 7. the lot abutting the subject property was granted permission to be divided into <br /> two buildable lots in 1985. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on October 14, 1998 to grant the <br /> Variance to divide the lot into two lots and to grant a Variance of 21.31 feet from the <br /> frontage requirement on Lot 2. The permit is conditioned upon compliance with plans of <br /> Cape& Islands Engineering dated July 6, 1998. <br />
