Town of Mashpee <br /> BOARD OF APPEALS 16 Great Aeck Ppad Aorth <br /> Mashpee, Massachusetts 02649 <br /> Decision for a Variance <br /> 407 Monomoscoy Road <br /> RE: Robert 1, Webster V-98-144 407 & 409 Monomoscoy Road <br /> Map 124 Block 63 &Map 124 Block 62 <br /> A Petition was filed on October 5, 1998 by Robert 1. Webster of Watertown, <br /> Massachusetts for a Variance from Sections 174-21 and 174-31 of the Zoning By-laws <br /> for permission to vary the lot size on non-conforming lots with a non-conforming <br /> structure on properties located in an R-3 zoning district at 407 and 409 Monomoscoy <br /> Road (Map 124 Block 62 and Map 124 Block 63), Mashpee, MA. (Owner of record of <br /> 407 Monomoscoy Road: John A. Moore, Jr.) <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 3, 1998 and <br /> November 13,1998, a copy of which is attached hereto and made apart hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 18, 1998, at which time the following members of the Board of <br /> Appeals were present and acting throughout: James E. Regan III,Robert G. Nelson and <br /> Richard T. Guerrera. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape& Islands Engineering represented the applicant and <br /> referenced the plan showing that Mr. Webster owns a shed that lies over the property <br /> line. Mr. Webster proposes to purchase from Mr. Moore a 25-foot wide strip of land. Mr. <br /> Sanicki further stated that the lot frontages will remain the same on both parcels of land. <br /> However, the non-conforming lot frontages and lot sizes necessitate the need for relief <br /> from the Zoning By-law requirements. The proposal will require Planning Board <br /> approval, <br /> No other comments were received from abutters. <br />
