Mashpee Board of Appeals Robert 1. Webster V-98-144 2 <br /> FMINGS <br /> General Finding <br /> 1. Robert 1. Webster owns the property located at 409 Monomoscoy Road that <br /> currently consists of 16,750 square feet. <br /> 2. John A. Moore, Jr. owns the property located at 407 Monomoscoy Road that <br /> currently consists of 41,400 square feet. <br /> Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner, <br /> Specific Finding <br /> I. that relief may be granted without detriment to the public good. <br /> 2. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> 3. the shape and topography affect the subject lots and not the zoning district in <br /> which they are located. <br /> 4. the neighboring lots on Monomoscoy Road are similar in nature. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on November 18, 1998 to grant the <br /> following Variances: <br /> I. 407 Monomoscoy Road, with lot frontage of 100 feet, will be reduced from <br /> 41,400 square feet (with the land transfer of 6,050 square feet to 409 <br /> Monomoscoy Road)to 3 5,3 50 square feet. <br /> 2. 409 Monomoscoy Road, with lot frontage of 50 feet, will increase from <br /> 16,750 square feet (with the land transfer of 6,050 square feet from 407 <br /> Monomoscoy Road)to 22,800 square feet. <br /> 3. compliance with plan entitled "Plan of Land Located in Mashpee—Mass. <br /> Prepared for Robert 1. Webster, being Plan No. 100198, dated October 1, <br /> 1998". <br />
