Board of Appeals John L, & Cynthia J. West SP-98-145 2 <br /> The Board of Health has approved the proposal to relocate an existing septic <br /> system. The Conservation Commission has also approved the entire project, with orders <br /> of conditions pending approval from the Board of Appeals. <br /> No comments were received from abutters, <br /> FINDINGS <br /> General Finding <br /> 1. the subject property is located at 26 Russell Road and consists of 1.2 acres, <br /> Special Permit Criteria <br /> Section 174-25A.8 of the Mashpee Zoning By-laws provides for"conversion of <br /> an existing dwelling to accommodate not more than two (2) families". <br /> Specific Finding <br /> I. the proposed addition conforms to the setback requirements. <br /> 2. the proposed addition will be farther from the wetlands than the existing <br /> structure. <br /> 3� the changes between the proposed addition and the prior one will result in an <br /> increase in lot coverage to only 6.8%, and is well under the allowed 20%. <br /> 4. there is adequate land to provide sufficient parking. <br /> 5. the owner has entered an agreement to contribute toward regrading and <br /> maintenance of Russell Road to allow access for Fire Department and <br /> emergency apparatus and equipment. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded, the Board of Appeals voted unanimously on November 18, 1998 to grant a <br /> Special Permit with the following conditions: <br /> I. that the in-law apartment shall be used for family members only. <br /> 2. that upon sale of the home, the new owners must abide by these conditions; <br /> ensuring that the in-law apartment shall remain in use by family members <br /> only and shall not be used for rental purposes. <br /> 3. in the spirit of compliance with §174-32 of the Zoning By-laws and due to the <br /> additional use of the road with construction of the in-law apartment,the <br /> applicant shall maintain the road ftorn Monomoscoy Road to the hydrant on <br /> Russell Road with a minimum width of 14 feet and a minimum vertical <br /> clearance of 13 feet six inches, <br /> 4. compliance with plans of Cape & Islands Engineering dated August 10, 1998, <br /> revised September 9, 1998 and October 14, 1998. <br />
