(Owner of record: <br /> Christopher Burden TR.) <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on January 3, 1997 and January 10, 1997, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center <br /> on Wednesday, January 22, 1997 at 7:30 P.M. at which time the following members of <br /> the Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br /> Engineer Michael Grotzke represented the applicant and presented a plan of the lot <br /> with the layout of the proposed house. He informed the Board that the Conservation <br /> Commission had approved the location of the house 35' from the wetlands. Comments <br /> were received from abutters objecting to the application and from residents of Little Neck <br /> Bay who were opposed to the proposed construction. The Building Inspector informed <br /> the Board that the lot was a buildable lot without the variance. <br />
