Board of Appeals Howard Glaser - V-97-09 2. <br /> FINDINGS: <br /> 1. the subject property is a 15,088 square foot lot in the Little Neck Bay cluster <br /> subdivision. The zoning in the area requires 15 foot sideline setbacks and front <br /> setbacks of 30 feet. <br /> 2. there was no evidence presented showing that a literal enforcement of the <br /> provisions of the Zoning By-laws would result in substantial hardship. <br /> 3. reasonable use can be made of the property without a variance. <br /> For the foregoing reasons, the Board of Appeals determined that the applicant <br /> failed to meet the conditions necessary for the granting of a Variance. The Board did not <br /> find that desirable relief could be granted without substantial detriment to the public good <br /> and without nullifying or substantially derogating from the intent or purpose of the Zoning <br /> By-laws. <br /> Upon motion duly made and seconded, the Board of Appeals voted on January 22, <br /> 1997 to deny the application for a Variance without prejudice. <br />
