Board of Appeals Howard Glaser - V-97-09 2.
FINDINGS:
1. the subject property is a 15,088 square foot lot in the Little Neck Bay cluster
subdivision. The zoning in the area requires 15 foot sideline setbacks and front
setbacks of 30 feet.
2. there was no evidence presented showing that a literal enforcement of the
provisions of the Zoning By-laws would result in substantial hardship.
3. reasonable use can be made of the property without a variance.
For the foregoing reasons, the Board of Appeals determined that the applicant
failed to meet the conditions necessary for the granting of a Variance. The Board did not
find that desirable relief could be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent or purpose of the Zoning
By-laws.
Upon motion duly made and seconded, the Board of Appeals voted on January 22,
1997 to deny the application for a Variance without prejudice.
