Board of Appeals Owen W. and Georgia M. Welch - SP-97-16 2. <br /> FINDINGS <br /> A. General <br /> 1. the subject lot contains 14,300 square feet fronting on Popponesset Creek <br /> 2. the immediate neighborhood consists of single family homes of similar size <br /> 3. the lot is located in the New Seabury subdivision but is not part of the cluster <br /> zoning section. <br /> B. Special Permit Criteria <br /> Section 174-24 of the Mashpee Zoning By-laws and Mass. General Law Chapter <br /> 40A, Chapter 9 require a finding that the proposed use is consistent with the general <br /> purpose and intent of the By-laws and will not be a detriment to the neighborhood. <br /> C. Specific Findings <br /> 1. the proposed reconstruction on the site will conform to the setback and lot <br /> coverage requirements of present zoning. <br /> 2. the site conditions will be improved with the installation of a new Title V septic <br /> system. <br /> 3. the proposed reconstruction has been approved by the Conservation <br /> Commission. <br /> 4. the site is both adequate and suitable for the proposed use and provides <br /> adequate land area for parking. <br /> 5. the use is in harmony with the general purpose and intent of the Zoning By- <br /> laws. <br /> For the foregoing reasons the Board determined that the applicant met the criteria <br /> necessary to grant a Special Permit. Upon motion duly made and seconded, the Board of <br /> Appeals voted unanimously on February 12, 1997 to grant the Special Permit. The Permit <br /> is conditioned upon compliance with plans of Levy, Eldredge & Wagner Associates <br /> revised November 29, 1996. <br />
