Board of Appeals Cornish Nominee Trs. - SP-97-23 2. <br /> FINDINGS <br /> A. General <br /> 1. the site contains 37,996 square feet. <br /> 2. the site is located in a C-I zoning district and the proposed use is an allowed <br /> use upon grant of a Special Permit by the Board of Appeals. <br /> B. Special Permit Criteria <br /> Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning By-law <br /> require that the permit granting authority determine that the proposed use and <br /> development are consistent with applicable law, rules and regulations; that there will be no <br /> adverse affect on public health or safety;that there will not be an excessive demand upon <br /> community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environment. <br /> C. Specific Findings <br /> I. there is adequate on-site parking to accommodate the business. <br /> 2. the use is in harmony with the general purpose and intent of the By-laws and <br /> complies with the provisions therein. <br /> 3. the Board found that the proposed issuance of a Special Permit willnot <br /> adversely affect public health, safety or welfare and would not be detrimental <br /> to the Town. <br /> In view of the foregoing, the Board of Appeals found that the Applicant met the <br /> criteria necessary for the granting of a Special Permit. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on March 26, 1997 to grant the <br /> Special Permit with the condition that the proposed plans be approved by the Design <br /> Review Committee. <br />
