Board of Appeals John H. and Eileen McCarthy- SP-97-22 2. <br /> FINDINGS <br /> A. General <br /> 1. the subject property is located at 5 Squaw's Lane and contains 10,902 square <br /> feet. <br /> 2. the immediate neighborhood consists of single family homes many of which <br /> have been improved with additions or reconstruction. <br /> 3. the existing structure on the property was built before zoning in Mashpee and <br /> is a pre-existing non-conforming building. <br /> B. Special Permit Criteria <br /> Section 174-17 of the Mashpee Zoning By-laws and MGL Chapter 40A, Section <br /> 6, require a finding that the extension, alteration or change shall not be substantially more <br /> detrimental to the neighborhood than the existing non-conforming use. <br /> C. Specific Findings <br /> I. the proposed changes between the existing dwelling and the proposed <br /> additions will not increase the non-conforming nature of the structure and will <br /> not result in a structure or use which is more detrimental to the neighborhood <br /> than the prior non-conforming structure and use. <br /> 2. the proposed additions will result in lot coverage of 12.9% where 20% is <br /> allowed. <br /> 3. the site is both adequate and suitable for the proposed use and provides <br /> adequate land area for parking. <br /> 4. the use is in harmony with the general purpose and intent of the By-laws <br /> For the foregoing reasons, the Board determined that the applicant met the criteria <br /> necessary to grant a Special Permit. Upon motion duly made and seconded the Board of <br /> Appeals voted unanimously on March 12, 1997 to grant the Special Permit. The Permit is <br /> conditioned upon compliance with plans of Cape& Islands Engineering dated February 5, <br /> 1997. <br />
