Lincoln - V-97-32 2. <br /> d <br /> d <br /> o FINDINGS <br /> General Findings <br /> 1. the subject lot contains 1.76 acres and conforms to the 60,000 square foot <br /> minimum size requirements of the R-5 zoning district. <br /> 2. the immediate neighborhood consists of single family homes on similar or <br /> smaller lots. <br /> 3. the parcel was created in 1985 by an Approval Not Required Plan and an <br /> identical Variance for frontage was granted by the Board of Appeals on <br /> December 11, 1985. <br /> Variance Criteria: <br /> Section 10 of Chapter 40A requires that the permit granting authority determine that <br /> there are circumstances relating to the shape and topography which affect this lot and not <br /> the district in which it is located and that a literal enforcement of the by-laws would <br /> t involve hardship. <br /> Specific Findings <br /> 1. the parcel is long and narrow with substantial topographical changes <br /> throughout creating a hardship in the use of the land.. <br /> 2. the parcel slopes and drops severely from Pimlico Pond Road to Wakeby <br /> e <br /> Pond. <br /> 3. the topography and shape affect this lot and not the zoning district in which it <br /> is located. <br /> 4. the Board determined that desirable relief may be granted without derogating <br /> from the intent and purpose of the Zoning By-laws and without detriment to <br /> the public good. <br /> In view of the foregoing,the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on April 23, 1997 to grant a variance <br /> from the frontage requirement of 10.62 feet to allow frontage of 139.38 feet. <br /> r <br /> a <br />
