Board of Appeals Paul Tibets - V-97-25 2. <br /> FINDINGS <br /> A. General <br /> 1. the subject property contains 4,250 square feet and is located at the corner of <br /> " Sakonnet Drive and Old Brickyard Road. <br /> 2. the immediate neighborhood consists of single family homes of similar size <br /> many of which have been improved with additions or decks. <br /> 3. the proposed deck will result in a 11.5 foot setback from Sakonnet Drive. <br /> B. Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship. <br /> Specific Findings <br /> 1. the location of the house on the corner lot limit areas of expansion. <br /> 2. the applicant has maintained the setback from Old Brickyard Road and the side <br /> setback to the adjoining lot. <br /> 3. the Board determined that a Variance in front setbacks was not necessary since <br /> the lot predated zoning. <br /> 4. the Board determined that a Variance in lot coverage was required to allow the <br /> increase the coverage from 19.8%to 24.3%. <br /> 5. the Board determined that desirable relief may be granted without derogating <br /> from the intent and purpose of the Zoning By-laws and without detriment to <br /> the public good. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> May 14, 1997 to grant a Variance of 4.3%to allow lot coverage of 24.3%. The Variance <br /> is referenced by plans of Cape and Islands Engineering dated January 29, 1997. <br />
