Board of Appeals Cape Cod Coffee - Coffee Roasters SP-97-37 2. <br /> FINDINGS <br /> A. General <br /> 1. the site is a 3.60 acre property in a C-2 zoning district at 348 Main St. <br /> 2. retail sales are an approved use in the C-2 zoning district upon the grant of a <br /> Special Permit from the Board of Appeals. <br /> B. Special Permit Criteria <br /> Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning By-law <br /> require that the permit granting authority determine that the proposed use and <br /> development are consistent with applicable law, rules and regulations;that there will be no <br /> adverse affect on public health or safety;that there will not be an excessive demand upon <br /> community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environmental factors listed in Section 174-24.C(2). <br /> C. Specific Findings <br /> 1. the subject property has been in commercial use since 1974. <br /> 2. the subject property is now serviced by a public water supply to conform to <br /> Board of Health requirements. <br /> 3. the subject property contains enough square feet to meet the requirements for <br /> parking spaces. <br /> 4. the use will not create any excessive demand upon municipal services or <br /> facilities and will not have any significant impact upon environmental issues. <br /> 5. the Board found that the granting of a Special Permit would not be detrimental <br /> to the Town and was in harmony with the purpose and intent of the Zoning <br /> By-laws. <br /> In view of the foregoing, the Board of Appeals found that the Applicant met the <br /> criteria necessary for the granting of a Special Permit. Upon motion duly made and <br /> seconded the Board of Appeals voted unanimously on May 14, 1997 to grant the Special <br /> Permit. <br />
