Board of Appeals Cooke's -Mashpee Inc. SP-97-45 2. <br /> The Board of Appeals made the following findings: <br /> 1. the proposed signage requires a Special Permit from the Board of Appeals <br /> under the revised sign by-laws approved by the Town of Mashpee at the May, <br /> 1997 Town Meeting. <br /> 2. Section 174-51.13 of the revised sign by-laws requires a Special Permit for all <br /> signs exceeding twenty(20) square feet. The proposed free-standing sign will <br /> be (40) square feet. <br /> 3. Section 174-55.F.2 of the revised sign by-laws requires a Special Permit for <br /> wall-mounted back-lit lettering signs. The proposed building sign will be a <br /> wall-mounted back-lit lettering sign. <br /> 4. Section 174-55.13 allows building signs up to ten percent (10%) of the <br /> aggregate square footage of the front wall area. The proposed building sign is <br /> approximately 9% of the aggregate square footage of the front wall area. The <br /> Board determined that the proposed sign conforms to the By-law and that no <br /> Variance is required. <br /> 5. The proposed signage has been approved by the Design Review Committee <br /> and a mock-up of the free standing sign was placed on the site in advance of <br /> the hearing. No objections were received by the Board. <br /> 6. The Board found that the proposed signage will provide clear identification of <br /> the site and the proposed lighting will not produce excessive glare. <br /> 7. The Board found that the granting of a Special Permit would not be <br /> detrimental to the neighborhood or to the Town and that the use is in harmony <br /> with the general purpose and intent of the Zoning By-laws. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously to <br /> grant the Special Permit for the two signs. The Permit is conditioned upon compliance <br /> with the sign location in the landscape plan 96-176 of Down Cape Engineering Inc. dated <br /> June 23, 1996. <br />
