Inc. SP-97-46 Map 81 Block 23 <br /> A Petition was filed by Deer Crossing Associates - Italian Market - L.L. R.C., Inc. <br /> on June 2, 1997 for a Modification to Special Permit 96-3 under Sections 174-25.E.2, <br /> 174-25.H.6 and 174-25110 of the Zoning By-laws to allow the use of an existing patio <br /> for seasonal outdoor dining as an accessory use to an eat-in delicatessen and market. The <br /> applicant also requests to amend the approved landscape plan and rear parking area on <br /> property located in a C-1 zoning district at 681 Falmouth Road (Map 81, Block 23) <br /> Mashpee, MA. The site is Building A of Deer Crossing. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on June 6 and June 13, 1997, a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 25, 1997 at which time the following members of the Board of Appeals <br /> were present and acting throughout: James E. Regan III, Cheryl A. Hawver and Michael <br /> A. Makunas. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Robert Mills represented the applicant and presented revised plans of the <br /> site including landscaping, dining patio, patio access door and three additional parking <br /> spaces. He explained that Special Permit 96-3 had been issued for an addition to Building <br /> A and that the patio, parking and landscaping had not been approved on the original plans. <br /> He informed the Board that they are requesting the Special Permit for permission to allow <br /> the use of the patio for seasonal dining with eight tables of four as well as the existing <br />
