Partnership). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on July 4 and July 11, 1997, a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 23, 1997 at 7:30 P.M. at which time the following members of the Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, Cheryl A. Hawver <br /> and Michael A. Makunas. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Mashpee <br /> Zoning By-laws. <br /> Douglas Storrs of Mashpee Commons represented the Petition. He presented the <br /> Board with the revised plan for Building 11B limiting the height to 35 feet and the second <br /> floor plans for the thirteen apartments. He explained that Special Permit 97-11 had <br /> permitted 13,700 square feet of first floor space for retail use and 13,500 square feet of <br /> second floor space for residential use but had not referenced the thirteen apartments. <br />
