Board of Appeals Mashpee Commons Limited Partnership - SP-97-51 2. <br /> The Board reviewed the 1986 Special Permit which granted 100 residential units <br /> and determined that these can be transferred between buildings and that 87 units remain <br /> after the thirteen are used in Building I IB. <br /> FINDINGS <br /> 1. the subject site is a 40.3 acre lot known as Mashpee Commons and located in a <br /> C-1 zoning district at 38 Nathan Ellis Highway <br /> 2. the property was issued a Special Permit in 1986 for retail, office, restaurant <br /> and residential use to be planned in several phases. <br /> 3. the proposed construction has been approved by the Design Review <br /> Committee as required in the original Special Permit. <br /> 4. the proposed use of 13 dwelling units as residential apartments on the second <br /> floor of I IB has been approved by the Board of Appeals as required in the <br /> original Special Permit. <br /> 5. the Board found that the use is in harmony with the general purpose and intent <br /> of the Zoning By-laws and complies with the conditions therein. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> July 23, 1997 to grant the Modification of Special Permit 97-11 to approve 13,700 square <br /> feet of first floor space for retail, office or restaurant use and 13,500 square feet of second <br /> floor space for 13 apartments for residential use. The Permit is conditioned upon <br /> compliance with plans of Imai/Keller Inc. for Building 11B revised June 27, 1997 and <br /> plans for the thirteen apartments revised June 27, 1997. <br />
