Perez - V-97-47 13 Wheelhouse Lane <br /> Map 120 Block 169 <br /> A Petition was filed on June 9, 1997 by Luis A. Perez of Lexington, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the front and rear setback requirements. The applicant requested a Variance of 4.9 <br /> feet to allow a front setback of 25.1 feet from Wheelhouse Lane and a Variance of 5 feet <br /> to allow a rear setback of 15 feet on property located in an R-3 zoning district at 13 <br /> Wheelhouse Lane (Map 120, Block 169)Mashpee, MA. (Owner of record: Mark C. <br /> Gildea TRS.) <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper. <br /> of general circulation in the Town of Mashpee, on July 4 and July 11, 1997, a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 23, 1997 at 7:30 P.M. at which time the following members of the Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, Cheryl A. Hawver <br /> and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> I provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br /> Engineer Michael Grotzke represented the applicant and presented plans for a <br /> house and pool. The proposed construction would extend into the required front and rear <br /> setback areas. Comments were received in opposition to the Variance request from <br /> several abutters and the Little Neck Bay Homeowner's Association. A Petition was <br /> presented to the Board from several owners of property in Little Neck Bay opposed to the <br /> request. <br />
