Perez - V-97-47 2. <br /> FMOS <br /> General Findings: <br /> 1. the subject property is located at 13 Wheelhouse Lane and contains 12,777 <br /> square feet. <br /> 2. the property is located in the Little Neck Bay cluster subdivision with zoning <br /> setback requirements of 30 foot front, 15 foot side and 20 feet rear. <br /> Variance Criteria: <br /> Section 10 of Chapter 40A requires that the permit granting authority determine that <br /> there are circumstances relating to the shape and topography which affect this lot and not <br /> the district in which it is located and that a literal enforcement of the by-laws would <br /> involve hardship. <br /> Specific Findings: <br /> 1, the shape and topography of the lot do not prevent the placement of a house <br /> on this lot. <br /> 2. reasonable use can be made of the property without a variance. <br /> 3. the Board determined that the hardship in the use of the land was self created. <br /> 4. the Board found that desirable relief could not be granted without derogating <br /> from the intent and purpose of the zoning By-laws. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> August 27, 1997 to deny the application without prejudice. <br /> I <br />
