Martick- V-97-55 49 Amy Brown Road <br /> Map 109 Block 2 <br /> A Petition was filed by Paul G. Martick of Mashpee, Massachusetts for a Variance <br /> from Section 174-32 of the Zoning By-laws to allow the construction of a single family <br /> dwelling on an unpaved road on property located in an R-3 zoning district at 49 Amy <br /> Brown Road (Map 109, Block 2)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on August 22 and August 29, 1997, a <br /> copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 10, 1997 and continued to January 14, 1998, at which time the <br /> following members of the Board of Appeals were present and acting throughout: Edward <br /> M. Govoni, James M. Dorgan and Michael A. Makunas. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Martick represented his application and informed the Board that several <br /> homes had been built on Amy Brown Road and that the Planning Board was now <br /> approving the division of lots at the end of the road. The Board requested to be notified <br /> when the Planning Board released the covenant on the lots at the end of the road. <br /> At the January 14, 1998 meeting of the Board of Appeals the Board was informed <br /> that the Planning Board had released the covenant and that some pruning had been done <br /> to improve the road. <br /> i <br />
