Board of Appeals Paul G. Martick -V-97-55 2. <br /> The Board of Appeals made the following findings: • <br /> 1. the undeveloped lot contains 37,200 square feet and there are lots of similar <br /> size in the vicinity which have been developed with single family dwellings. <br /> 2. the unpaved Amy Brown Road is accessible to vehicular traffic and is typical of <br /> many unpaved roads in the Town. <br /> 3. the shape and topography of the lot with wetland area create a hardship in the <br /> use of the land. <br /> 4. other than a building lot, said land could be put to no other profitable use. <br /> 5. the lot has been maintained as a separate buildable lot on the assessor's <br /> records. <br /> On the basis of these factors, the Board determined that a literal enforcement of <br /> the By-law would result in substantial hardship to the Petitioner and that desirable relief <br /> could be granted without nullifying from the intent or purpose of the Zoning By-law and <br /> without detriment to the public good. <br /> Upon motion duly made and seconded, the Board of Appeals voted unanimously <br /> on January 14, 1998 to grant the Variance. The Variance is conditioned upon compliance <br /> with plans of Cape& Islands Engineering dated June 13, 1997. <br /> q <br />
