Mohns - SP-97-58 2. <br /> FINDINGS <br /> General <br /> 1. the subject property is located at 63 Frog Pond Close (Map 90, Block 79A) <br /> and contains 40,520 square feet fronting on Popponesset Bay. <br /> 2. the immediate neighborhood consists of single family homes of similar size. <br /> Special Permit Criteria <br /> Section 174-25.A.8 of the Mashpee Zoning By-laws and Mass. General Law <br /> Chapter 40A, Section 9 requires a finding that the use is in harmony with the general <br /> purpose and intent of the by-laws and complies with the provisions set forth therein. <br /> Specific Findings <br /> 1. the second apartment complies with the requirements of the By-laws in that it <br /> contains more than 750 square feet of habitable floor space and there is no <br /> external evidence of occupancy by more than one family. <br /> 2. the conversion of a section of the house to the apartment did not create any <br /> intrusion on the setback requirements. <br /> 3. there is adequate land area to provide sufficient parking <br /> 4. the proposed use is in harmony with the purpose and intent of the by-law. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded the Board of Appeals voted unanimously on September 24, 1997 to grant a <br /> Special Permit for an existing apartment in a single family dwelling at 63 Frog Pond <br /> Close. The Permit is subject to the following condition: <br /> the existing apartment is not be used as a rental unit. <br />
