Kyros TRS. - (Chaudhry's Market) - SP-97-61 44 Falmouth Road <br /> Map 55, Block 18 <br /> A Petition was filed by Stephen C. Kyros TRS. of Mashpee, Massachusetts for a <br /> Special Permit under Sections 174-25.E.1 and 174-25.H.6 of the Zoning By-laws for <br /> permission to operate a grocery/convenience store (Chaudhry's Market) in a portion of a <br /> building permitted for a donut and pastry show (Honeydew Donuts) on property located <br /> in a C-2 zoning district at 44 Falmouth Road (Map 55, Block 18)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on October 3 and October 10, 1997, a <br /> copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 22, 1997 and continued to January 14, 1998, at which times the <br /> following members of the Board of Appeals were present and acting throughout: Edward <br /> M. Govoni, Cheryl A. Hawver and Michael A. Makunas. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane represented the applicant and informed the Board that the <br /> Building Inspector had requested an additional Special Permit for the market. He <br /> explained that the original Special Permit for the donut shop was not specific on the <br /> occupancy of the space planned for expansion although the approved site plan for the <br /> Permit included the space planned for Phase II expansion. The Board was informed that a <br /> Special Permit had also been issued for the signage. <br /> Comments were received questioning the curb cut permits at the site and the <br /> Board determined that this was not under their jurisdiction. <br />
