Board.of Appeals Stephen C. Kyros TRS. - SP-97-61 2. <br /> FINDINGS <br /> 1. The site is located at 44 Falmouth Road and contains 32,460 square feet in a <br /> commercially zoned district. <br /> 2. The use is allowed in the C-2 zoning district with a Special Permit from the <br /> Board of Appeals. <br /> 3. The plans have been reviewed and approved by the Design Review Committee. <br /> 4. The addition complies with existing-setback requirements. <br /> 5. The site is both adequate and suitable for the proposed use and provides <br /> adequate land for parking. <br /> i <br /> 6. The Board found that the proposed issuance of a Special Permit as applied for <br /> by the applicant will not adversely affect public health, safety or welfare; create <br /> an excessive demand on community facilities; have a significant adverse impact <br /> on traffic flow and safety or otherwise be detrimental to the Town or to the <br /> neighborhood. <br /> For the foregoing reasons the Board determined that the applicant met the criteria <br /> I necessary to grant a Special Permit. Upon motion duly made and seconded, the Board of <br /> Appeals voted unanimously on January 14, 1998 to grant the Special Permit with the <br /> following condition: the landscaping at the site will conform to the landscaping plan of <br /> Mary LeBlanc revised by the Design Review Committee on January 14, 1998. The <br /> applicant has posted a $5,000 landscape bond for the completion of the landscaping. <br />
