Board of Appeals Andy's Market -Bryan W. Anderson SP-97-73 2. <br /> FINDINGS <br /> A. General: <br /> 1, the subject lot contains 43,376 square feet and is improved with a retail store <br /> type building constructed approximately 1959. <br /> 2. the subject lot is zoned for commercial use and retail sales and storage are <br /> allowed uses. <br /> B. Special Permit Criteria <br /> Section 174-17 of the Mashpee Zoning By-laws and Mass. General Law Chapter <br /> 40A, Chapter 6, require a finding that the extension, alteration or change shall not be <br /> substantially more detrimental to the neighborhood than the existing non-conforming use. <br /> C. Specific Findings: <br /> 1. the proposed changes between the existing building and the new addition will <br /> increase the non-conforming nature of the structure since the front setback <br /> from Wampanoag Avenue will be less than 75'. <br /> 2. the changes will not result in a structure of use which is more detrimental to <br /> the neighborhood than the prior non-conforming structure and its use. <br /> 3. the proposed lot coverage will be 19.8% and conforms to the 20% maximum <br /> lot coverage requirement. <br /> 4. the site is both adequate and suitable for the proposed use and provides <br /> adequate land area for parking. <br /> 5. the use is in harmony with the general purpose and intent of the Zoning By- <br /> laws <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> December 10, 1997 to grant the Special Permit for the expansion of the building and three <br /> signs to exceed 20 square feet each subject to the following conditions: <br /> 1. the permit is subject to compliance with plans of Christopher Costa dated <br /> October 14, 1997 and L. F. Giampietro dated October 4, 1997. <br /> 2. landscaping is to be perpetually maintained at the rear of the lot to assure <br /> privacy from the adjoining lot. <br /> 3. paint colors are to be Piedmont Gray#1579, Cliffside Gray#74 and Classic <br /> Burgundy#26 as approved by the Design Review Committee. <br /> 4. sign design is to conform to designs of Day Sign Company signed December <br /> 10, 1997. <br /> r <br /> I <br />
