Board of Appeals Mark R. Efron - SP-96-13 2. <br /> Findings: <br /> a. General : <br /> 1. the subject property is located at 358 Monomoscoy Road (Map 120, Block 109) and <br /> consists of.847 acres fronting on Great River. The property has been improved with <br /> two dwellings, a garage and dock and boat ramp. <br /> 2. the immediate neighborhood consists of single family homes of similar size many of <br /> which have been improved with additions and/or reconstruction. <br /> b. Special Permit Criteria <br /> Section 174-17 and Mass. General Law Chapter 40A, Chapter 6 require a finding that <br /> the extension, alteration or change shall not be substantially more detrimental to the <br /> neighborhood that the existing non-conforming use. <br /> c. Specific Findings: <br /> 1. the proposed addition does not increase the non-conformity and results in a sideline <br /> setback of 29.9' which exceeds the required 15' sideline setback. <br /> 2. the proposed addition will not encroach on the wetlands. <br /> 3. the changes between the proposed dwelling with the addition and the prior one will <br /> result in an increase in lot coverage from 7%to 10% and 20% lot coverage is <br /> permitted. <br /> 4. the proposed construction of the addition will permit substantial improvement to the <br /> existing site conditions with the addition of a Title V sewage disposal system. <br /> 5. there is adequate land area to provide sufficient parking. <br /> 6. the plans of the proposed addition, its location on the lot and the intended use of the <br /> structure comply with the general provisions set forth within the by-laws. <br /> 7. the proposed expansion will not be a detriment to the neighborhood. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the the criteria necessary for the granting of a Special Permit. Upon motion duly <br /> made and seconded the Board of Appeals voted unanimously on February 28, 1996 to <br /> grant the Special Permit for a house addition and deck. The Permit is conditioned with <br /> compliance of plans of J. E. Landers-Cauley dated November 20, 1995 and house <br /> elevations by Devlin Designs. <br />
