Board of Appeals James G. Haidas SP-96-52 4. <br /> In view of the foregoing, the Board of Appeals found that the Applicant met the <br /> criteria necessary for the granting of a Special Permit. The Board of Appeals discussed <br /> the issue of outdoor dining and decided that, for the time being, there should be none but <br /> that the Petitioner may petition the Board in the future to allow outdoor dining. <br /> Upon motion duly made and seconded the Mashpee Board of Appeals voted <br /> unanimously on September 11, 1996 to grant a Special Permit for the construction of a <br /> 170 seat restaurant with the condition that no outside dining be permitted. Outside dining <br /> can only be permitted if a separate application for accessory use is applied for and granted. <br /> The Special Permit is also conditioned upon compliance with the following plans signed by <br /> the Chairman of the Mashpee Board of Appeals: the site development plan of Down <br /> Cape Engineering, Inc. revised 8/12/96 and 8/26/96; landscape plan of Mary L. Leblanc <br /> and New England Design building plan and the posting of a $10,000 landscape bond with <br /> the Town Treasurer. <br />
