Board of Appeals James G. Haidas SP-96-52 3. <br /> Specific Findings: <br /> 1. The subject property has been commercially or business zoned since 1959. <br /> 2. The proposed use as a restaurant under Section 174-25.E.2 has been an <br /> approved use in a commercial zone since the earliest zoning in Mashpee and <br /> requires a Special Permit from the Board of Appeals. <br /> 3. The subject property is serviced by a public water supply and the Applicant <br /> proposed the installation of a denitifrifying wastewater treatment system in <br /> conformance with Board of Health requirements. These will result in the <br /> restaurant having no adverse impact on the public health or environment. <br /> 4. The proposed restaurant building will consist of 5,464 square feet on the first <br /> floor and have a seating capacity of 170 patrons. <br /> 5. The proposed parking area will accommodate 84 spaces including handicap. <br /> 6. The use will not create any excessive demand upon municipal services or <br /> facilities and will not have any significant impact upon environmental issues of <br /> water or air quality, wildlife habitat, noise vibration or electrical disturbance. <br /> 7. The use will not create unacceptable levels of trash. <br /> 8. The proposal was reviewed and approved by the Design Review Committee. <br /> 9. The Board found that the granting of a Special Permit would not be <br /> detrimental to the Town. <br />
