I <br /> iumh <br /> Town o Mas pee <br /> 16 Great Xeck Aoad Arth <br /> Mashpee, Massachusetts 02649 <br /> BOARD OF APPEALS <br /> Decision on an Appeal <br /> RE: Peter and Laraine Michaelson TRS.-N.O.A. 96-56 14 Pond View Drive <br /> (Map 71, Block 109) <br /> 10 Pond View Drive <br /> (Map 71,Block 108) <br /> A Notice of Appeal of the Building Inspector's Decision was filed on August 19, <br /> 1996 by Peter and Laraine Michaelson TRS. of Mashpee, Massachusetts appealing the <br /> Decision of the Building Inspector denying building permits in an R-5 zoning district for <br /> property located at 14 Pond View Drive(Map 71, Block 109) and 10 Pond View Drive <br /> (Map 71, Block 108) Mashpee,Massachusetts. The denials were based on the <br /> determination by the Building Inspector that the lots do not meet the requirements of <br /> Section 174-21 of the Zoning By-laws or M.G.L. Chapter 40A, Section 6. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on August 23, 1996 and August 30, 1996, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center <br /> on Wednesday, September 11, 1996 at 7:30 P.M.at which time the following members of <br /> the Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 8. <br /> Mr. Michaelson represented his application and reviewed the history of the <br /> Winslow Farms Subdivision which was approved in 1986 and went into bankruptcy in <br /> 1993. He presented deed searches on the two subject lots. <br />
