I iumh Town o Mas pee 16 Great Xeck Aoad Arth Mashpee, Massachusetts 02649 BOARD OF APPEALS Decision on an Appeal RE: Peter and Laraine Michaelson TRS.-N.O.A. 96-56 14 Pond View Drive (Map 71, Block 109) 10 Pond View Drive (Map 71,Block 108) A Notice of Appeal of the Building Inspector's Decision was filed on August 19, 1996 by Peter and Laraine Michaelson TRS. of Mashpee, Massachusetts appealing the Decision of the Building Inspector denying building permits in an R-5 zoning district for property located at 14 Pond View Drive(Map 71, Block 109) and 10 Pond View Drive (Map 71, Block 108) Mashpee,Massachusetts. The denials were based on the determination by the Building Inspector that the lots do not meet the requirements of Section 174-21 of the Zoning By-laws or M.G.L. Chapter 40A, Section 6. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on August 23, 1996 and August 30, 1996, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center on Wednesday, September 11, 1996 at 7:30 P.M.at which time the following members of the Board of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and Cheryl A. Hawver. This Decision is issued by the Mashpee Board of Appeals pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 8. Mr. Michaelson represented his application and reviewed the history of the Winslow Farms Subdivision which was approved in 1986 and went into bankruptcy in 1993. He presented deed searches on the two subject lots.
