I <br /> Board of AppealsPeter and Laraine Michaelson TRS. 2. <br /> FINDING OF FACTS <br /> 1. The Winslow Farms Subdivision was approved by the Planning Board on April <br /> 2, 1986. <br /> 2. The lot at 10 Pond View Drive (Map 71,Block 108)was sold by the developer <br /> on June 3, 1986 to Robert A. and Marcia Chaves. <br /> 3. The lot was sold to Gerald P. Downing on March 5, 1991. <br /> 4. The lot at 14 Pond View Drive (Map 71, Block 109) was sold by the developer <br /> on September 16, 1987 to Dennis G. and Linda J. Lefebvre. <br /> 5. The subdivision was foreclosed on June 1, 1993 by the National Credit Union <br /> Administration Board and sale of lots was prohibited due to the unfinished <br /> road work required by the Planning Board. <br /> 6. The subject lots were Purchased by Peter J. and Laraine Michaelson TRS.on <br /> January 3, 1996 subject to a Declaration of Protective Covenants of Winslow <br /> Farms. The applicants agreed to the completion of the road construction <br /> mandated by the covenants. <br /> 7. The Building Inspector refused building permits on these lots since he thought <br /> they had been held in common ownership by the original developer. <br /> The Board determined that the decision of the Building Inspector should be. <br /> reversed since the lots had been conveyed into separate ownership. Upon motion duly <br /> made and seconded the Board of Appeals voted unanimously on September 11, 1996 to <br /> uphold the Appeal and reverse the Decision of the Building Inspector. <br />
