Board of Appeals Dennis A. Scannell and Richard W. Mell SP-96-55 2. <br /> Special Permit Criteria <br /> Section 9 of Chapter 40A and Section174-24C of the Mashpee Zoning By-law <br /> require that the permit granting authority determine that the proposed use and <br /> development are consistent with applicable law, rules and regulations; that there will be no <br /> adverse affect on public health or safety; that there will not be an excessive demand upon <br /> community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environmental factors listed in Section 174-24.C(2). <br /> FINDINGS <br /> 1. the subject property is located is located at 31 Bowdoin Road and contains <br /> 45,000 square feet. <br /> 2. the current use for a well drilling business is a permitted use in the I-1 zoning <br /> district. <br /> 3. there is sufficient land area for the proposed addition which will conform to <br /> the setbacks requirements in this zoning district. <br /> 4. the use will not create any excessive demand on municipal services or facilities <br /> and will not have any significant impact upon environmental issues of water or <br /> air quality, wildlife habitat, noise vibration or electrical disturbance. <br /> In view of the foregoing, the Board of Appeals found that the Applicant met the <br /> criteria necessary for the granting of a Special Permit. Upon motion duly made and <br /> seconded the Mashpee Board of Appeals voted unanimously on September 11, 1996 to <br /> grant the Special Permit with the following conditions: <br /> 1. there is to be no storage of hazardous waste or gas or oil in the building. <br /> 2. that the addition be built in conformance with plans of Cape& Islands <br /> Engineering signed by the Chairman of the Board of Appeals. <br />
