Stavru - V-96-54 28 Main St. - Unit 40 <br /> Map 47, Block 29,Lot 40 <br /> A Petition was filed on August 2, 1996 by Elizabeth P. and Peter N. Stavru of <br /> Mashpee, Massachusetts for a Variance from Section 174-46.E.3 of the Zoning By-laws <br /> for permission to vary the setback requirement between buildings in an Open Space <br /> Incentive Development on property located in an R-5 zoning district at 28 Main St. -Unit <br /> 40 Stratford Ponds (Map 47, Block 29, Lot 40) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on August 23, 1996 and August 30, 1996, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center <br /> on Wednesday, September 11, 1996 at 7:30 P.M.and rescheduled to September 25, 1996 <br /> at which time the following members of the Board of Appeals were present and acting <br /> throughout: Edward M. Govoni, James E. Regan III and Richard T. Guerrera. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174- <br /> 46.E.3 of the Mashpee Zoning By-laws. <br /> Mr. Stavru informed the Board that the present bulkhead entrance is dangerous <br /> and presented plans to redesign it to eliminate three steps and enclose the area. Comments <br /> were received from the Fire Chief in favor of the variance if the exterior finish be <br /> constructed of a rated non-combustible material and that the exterior of the new basement <br /> door be constructed of a rated non-combustible material. No comments were received <br /> from abutters. <br />
