Ramsey - V-96-65 21 Whippoorwill Circle <br /> Map 125 Block 166 <br /> A Petition was filed by Robert E. and Helen E. Ramsey on September 24, 1996 for <br /> a Variance from Section 174-21 for property located in an R-3 zoning district at 17 <br /> Whippoorwill Circle(Map 125, Block 167) and a Variance from Section 174-31 for <br /> permission to vary the lot size and frontage on property located in an R-3 zoning district <br /> at 21 Whippoorwill Circle(Map 125, Block 166) to allow construction of a single family <br /> house. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on October 4, 1996 and October 11, 1996, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center <br /> on Wednesday, October 23, 1996 at 7:30 P.M.at which time the following members of <br /> the Board of Appeals were present and acting throughout: <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Town of Mashpee Zoning By-laws, <br /> Attorney Michael Dunning represented the applicants and informed the Board that <br /> the Ramseys own two separate adjoining lots on Whippoorwill Circle. He stated that one <br /> lot was purchased in 1976 and has their primary residence on it and the other lot is a <br /> vacant lot which was purchased in 1981. He explained that the vacant lot had always been <br /> held in separate ownership. The Board determined that the lot at 117 Whippoorwill Circle <br /> (Map 125,Block 167) did not require a Variance. <br />
