Board of Appeals Robert E. and Helen E. Ramsey - V-96-65 2. <br /> Findings: <br /> 1. the subject property at 21 Whippoorwill Circle (Map 125, Block 166) <br /> consists of a vacant lot of 13,485 square feet with 115 feet of frontage. <br /> 2. the subject property is shown as a separate lot on a 1968 Land Court Plan No. <br /> 26502-E. <br /> 3. the lot has been separately maintained on the Assessor's Records and is <br /> assessed as a buildable lot at $45,700 and is subject to water betterments. <br /> 4. the Board determined that, absent relief, the lot could not be used for a <br /> residence, the purpose for which it had been laid out and for which the balance <br /> of the lots in the subdivision were being used. <br /> 5. the Board found that a literal enforcement of the By-laws would produce a <br /> substantial hardship. The hardship relates to the size and circumstances of said <br /> lot clearly intended to stand on its own and not as part of the adjacent <br /> developed land. <br /> 6. the Board found that the granting of a Variance would not derogate from the <br /> intent of the By-laws nor would it be a detriment to the neighborhood. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> October 23, 1996 to grant the variance to allow the construction of a single family house <br /> on a 13,485 square foot lot with 115 foot frontage on property located at 21 <br /> Whippoorwill Circle(Map 125, Block 166). <br />
