Brennan 26 Bayshore Drive <br /> Map 108 Block 73 <br /> A Petition was filed on October 10, 1996 by William P. Brennan of Marlboro, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the side setback requirements to allow the construction of a single family house on <br /> property located in an 11-3 zoning district at 26 Bayshore Drive(Map 108, Block 73) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on October 25, 1996 and November 1, <br /> 1996, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center <br /> on Wednesday, November 13, 1996 at 7:30 P.M, at which time the following members of <br /> the Board of Appeals were present and acting throughout: Edward M. Govoni, Cheryl A. <br /> Hawver and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br /> Engineer John Slavinsky represented the applicant and explained that the lot was in <br /> a cluster subdivision created in 1984 and subject to 15 foot sideline setbacks. Comments <br /> were received from abutters objecting to the size of the proposed house and to the fact <br /> that the homeowner's association has not approved the plans. The Board was informed <br /> that other houses in the area had to be reduced in size to meet the sideline setback <br /> requirements. <br />
