Board of Appeals William P. Brennan - V-96-68 2. <br /> FINDINGS: <br /> 1. the subject property is a 19,757 square foot lot in the Seabrook Shores cluster <br /> subdivision. The zoning in the area requires 15 foot sideline setbacks. <br /> 2. the subject property is almost rectangular in shape and is not impacted by <br /> wetlands or unusual natural features. <br /> 3. there was no evidence presented showing that owing to circumstances relating <br /> to the soil conditions, shape or topography of such land that a literal <br /> enforcement of the provisions of the Zoning By-laws would result in <br /> substantial hardship. <br /> 4. reasonable use can be made of the property without a variance. <br /> For the foregoing reasons, the Board of Appeals determined that the applicant <br /> failed to meet the conditions necessary for the granting of a Variance. The Board did not <br /> find that desirable relief could be granted without substantial detriment to the public good <br /> and without nullifying or substantially derogating from the intent or purpose of the Zoning <br /> By-laws. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> November 13, 1996 to deny the application for a Variance without prejudice. <br />
