Board of Appeals Minutes - February 8, 1995 <br />Gregory J and Carol L. Yurek - Request a Special Permit under Section 174-25.I.9 of the <br />• Zoning By-laws for permission to construct a dock on property located in an R-3 zoning <br />district at 199 Daniel's Island Road (Map 100, Block 35) Mashpee, MA. <br />Members sitting: E. Govoni, C. Hawver, K. Marsters <br />Engineer Michael Grotzke represented the applicants and presented revised plans for a <br />96' dock in Popponesset Bay. He explained that the Harbormaster had objected to the <br />original length of 130'. Rick York, Shellfish Constable, informed the Board that he had <br />questioned the water depth studies used on the original plans and had checked the area <br />that day and determined that there would be 2' of water at the end of the 96' dock which <br />would be sufficient to protect the shellfish in the area. The Board determined that a 10' <br />sideline Variance was not necessary since earliest zoning in the area permitted the 10'. <br />Mr. Govoni moved to grant the Variance to allow the 96' length per the revised plans <br />dated 2/8/95 and the Special Permit. Mr. Marsters seconded. All agreed. The Special <br />Permit and Variance are subject to the conditions that the Conservation Commission <br />approve the plans or, if revisions are required, that the applicant apply to the Board of <br />Appeals for a modification of the plan reference. <br />John T. O'Neill - Requests a Special Permit under Section 17417 and 174-31 of the <br />Zoning By-laws for permission to expand a pre-existing non -conforming dwelling with a <br />house addition and deck on property located in an R-3 zoning district at 24 Taffrail Way <br />• (Map 112, Block 33) Mashpee, MA. <br />Members sitting: E. Govoni, J. Regan, C. Hawver <br />Michael Grotzke represented applicant and presented plans for a house addition to a pre- <br />existing non -conforming dwelling. He explained that the revised by-law excluding <br />wetlands from the computation of lot coverage resulted in an existing coverage of 23% <br />and that the addition would result in 26.2%. The Board determined that the addition <br />would not be a detriment to the area and would not encroach any further on wetlands. <br />Mr. Govoni moved to grant the Special Permit to allow the expansion and a 26.2% lot <br />coverage. Ms. Hawver seconded. All agreed. <br />March 8 meeting - Mr. Govoni moved to cancel the March 8 meeting of the Board. Mr. <br />Regan seconded.
