Board of Appeals Minutes -February 8, 1995 2 <br />Mr. Kirrane informed the Board that the applicants are sisters who purchased two <br />• residential lots in the South Cape Beach Estates in 1969 and constructed a single family <br />home on one of the lots in 1972. The vacant lot has been held as a separate lot since it <br />was purchased and is now serviced by Town water. He explained that the applicants <br />were not aware of Zoning By-law changes voted in 1990 which required that adjacent <br />vacant lots be held in separate names and that it would be a significant hardship if they <br />could not use the lot. Two letters were received from abutters in favor of the applicant. <br />Mr. Govoni moved to grant the Variance with the finding that without relief, the lot could <br />not be used for a residence which was the purpose for which it had been laid out and for <br />which the balance of the lots in the subdivision were being used. He noted that the lot is <br />bounded by two ways and was clearly intended to stand on its own and not as a part of <br />any adjacent developed land. Mr. Marsters seconded. All agreed. <br />Lawrence E. and Catherine E. Warner - The Board received a written request from <br />Attorney Kevin M. Kirrane, representing the Wamers, for a six month extension on a <br />Variance granted in 1994 which expires on March 14, 1995. Mr. Govoni moved to grant <br />the extension of the Variance. Mr. Regan seconded. Ms. Hawver agreed. <br />Gerald S. and Corinne R. Epstein - Request a Variance from Section 174-31 of the Zoning <br />By-laws for permission to vary the setback and lot coverage requirements in an R-3 <br />zoning district for property located at 23 Waterline Drive North (Map 120, Block 153) <br />• Mashpee, MA. <br />Members sitting: E. Govoni, J. Regan, C. Hawver <br />Engineer Michael Grotzke and Architect Fred Giampetro represented the applicants. Mr. <br />Grotzke explained that he had been working with the Conservation Commission to locate <br />the house as far from the wetlands as possible and this had resulted in the need to be <br />closer to the street on the front setback. Mr. Giampetro showed a model of the home and <br />explained the setbacks. The Board determined that a variance in the front setback was not <br />necessary because the applicable zoning allowed 30' front setback. <br />Ms. Hawver moved to grant the Variance of 4' on the side setback on the Northerly side <br />to allow for an I V setback and a Variance of 3' on the Southerly side to allow for a 12' <br />setback and to allow for lot coverage of 21%. Mr. Regan seconded. All agreed. The <br />Variance is subject to the applicant returning to the Conservation Commission for an <br />amended order of conditions. <br />Gregory J. and Carol L.
