• <br />TOWN OF MASHPEE <br />Board of Appeals <br />Minutes <br />Wednesday, March 29, 1995 <br />The Mashpee Board of Appeals held a meeting on Wednesday, March 29, 1995 at 7:30 <br />P.M. at the Mashpee Town Hall. Board members present were: James E. Regan III, <br />Cheryl A. Hawver, Robert G. Nelson and Kenneth E. Marsters. Board members absent <br />were Edward M. Govoni, John J. Friel and Arnold Mindick. Building Inspector William <br />F. Hauck was in attendance. <br />Daniel J. Donahue - Special Permit and Variance - From February 22, 1995 meeting. <br />Members sitting: J. Regan, C. Hawver, K. Marsters <br />Mr. Hauck informed the Board that the applicant has not yet received approval from the <br />Design Review Committee and that they will need a lighting plan, fencing plan and <br />dumpster enclosure plan. Allen Osgood, Architect, and Attorney James MacNeill, <br />representing Mr. Donahue, stated they would meet with Design Review as soon as <br />possible. <br />Mr. Marsters questioned the use of the second floor of the building and Mr. MacNeill said <br />it would be unheated and unfinished. <br />The Board determined that a Variance was not necessary since the size of the sign <br />conformed to the sign code. Mr. Regan moved to accept the written request to withdraw <br />the Variance application. Mr. Marsters seconded. All agreed. <br />Ms. Hawver moved to grant the Special Permit subject to the conditions that the applicant <br />receive approval from Design Review, post a $5,000 landscape bond with the Town <br />Treasurer and complete landscape work within 6 months of the completion of the building <br />and conform to the Board of Health requirements. Mr. Regan seconded. All agreed. <br />Ms. Hawver reviewed the following Findings for the Decision: <br />The current use of the premises as a contractor's storage and repair yard is a <br />valid pre-existing nonconforming use of the premises which originated <br />approximately in 1950. <br />The proposed additional use of the premises is allowed under Section 174-24 <br />in this C-2 district and the plan conforms to the current setback and parking <br />requirements. <br />
