Board of Appeals Minutes - May 24, 1995 2. <br />• Staci A. Cormier - Requests a Variance from Section 174-31 of the Zoning By-laws for <br />permission to vary the front and side yard setback requirements on property in an R-3 <br />zoning district at 39 Bayshore Drive (Map 108, Block 45) Mashpee, MA. (Owner of <br />record: Martha R. Hearn). <br />Members sitting: E. Govoni, C. Hawver, K. Marsters <br />Engineer David Sanicki asked that this application be considered together with the Myles <br />Huntington application. He explained that these lots were part of a Planning Board <br />subdivision which included building setback lines. He said that Conservation now requires <br />an additional buffer in the rear and this necessitates moving the houses forward on the lot. <br />He said both applications require a front and side yard setback variance. Mr. Marsters <br />explained that the homeowner's association requires a two -car garage. <br />Mr. Marsters moved to grant the Variance due to the unusual topography and <br />conservation buffer. The Variance would be a 9' front setback and 2.4' on the north side. <br />Mr. Govoni seconded. All agreed. <br />Deer Crossine Associates - Has Appealed the Decision of the Building Inspector under <br />Section 174-24.C.8 of the Zoning By-laws for refusal to issue a Building Permit for <br />Building E of Deer Crossing on property located in a C-1 zoning district at 681 Falmouth <br />Road (Map 81; Blocks 35, 64, 23, 32) Mashpee, MA. The applicant seeks an extension of <br />Special Permit 90-29 filed with the Town Clerk on May 29, 1990. <br />Deer Crossine Associates - Request a Variance from Sections 174-31 and 174-39 of the <br />Zoning By-laws for permission to vary the setback and parking requirements in a C-1 <br />zoning district on property located at 681 Falmouth Road (Map 81; Blocks 35, 64, 23, 32) <br />Mashpee, M.A. <br />Deer Crossing Associates - Request a Special Permit under Sections 174-17 and 174-25 <br />of the Zoning By-laws for permission to construct Building E of Deer Crossing on <br />property located in a C -I zoning district at 681 Falmouth Road (Map 81; Blocks 35, 64, <br />23, 32) Mashpee, MA. The proposed use of the building is a retail hardware store with <br />outside sales of plants and landscaping supplies and second floor office or retail use. The <br />Board of Appeals issued Special Permit 90-29 for a Building E on May 29, 1990 which <br />has now lapsed. The proposed building is to be located adjacent to Michael's Restaurant. <br />Members sitting: E. Govoni, C. Hawver, K.
