I/ <br />Board of Appeals Minutes - June 28, 1995 3. <br />• Richard and Jacinth E. Cooke - Request a Variance from Section 174-31 of the Zoning <br />By-laws for permission to vary the side line setback requirement to allow for a house <br />addition on property located in an R-5 zoning district at 49 Ashumet Avenue (Map 41, <br />Block 27) Mashpee, MA. <br />Members sitting: E. Govoni, J. Regan, C. Hawver <br />Mr. Cooke explained that he wanted to add a bedroom and deck which would result in a <br />sideline setback of 8.8'. Mr. Hauck explained that the original zoning allowed a 7 1/2' <br />sideline setback but he was requiring a minimum of 10'. The Board suggested that in the <br />future this type of application be handled as an Appeal of the Building Inspector's. <br />Decision rather than a Variance. <br />Mr. Govoni moved to grant the Variance of 1.2' to allow a sideline setback of 8.8' based <br />on the findings that the shape and topography of the lot prevented the building of the <br />addition in any other location and that it would not be detrimental to the neighborhood. <br />Mr. Regan seconded. All agreed. <br />Reorganization of the Board - Mr. Govoni explained that the reorganization will be voted <br />at the July 12 meeting. He explained that the Board is required to elect a Chairman and <br />Clerk. <br />• Correspondence - Mr. Govoni explained that the Board had received a letter of interest in <br />membership from William Zammer. He said a letter will be sent inviting Mr. Zammer to <br />the July 26 meeting. There was discussion that the current Associate Members have been <br />participating in more hearings and that attendance has been excellent. <br />Televising_ Meetings - Brad Caffyn discussed possibility of televising meetings. It was <br />agreed that the Board would be advised in advance. <br />July 12 meeting - The meeting will focus on reviewing Application Procedures of the <br />Board and only one continued hearing will be scheduled. <br />Meeting adjourned at 9:10 P.M. <br />Elinor Walsh <br />E <br />
