Board of Appeals Minutes September 13, 1995 2. <br />He said the parking requirement for the complex is 75 spaces and they have 78. He said <br />that the most intense use would be when other businesses were closed. He explained that <br />they will be going to the Design Review Committee for signage. Mr. Govoni said that the <br />DPW director was concerned about the stacking of the cars on the Nmigret Road <br />entrance. Mr. Govoni said they would have to have an employee working only on the <br />window and that the present three employees cannot handle the volume of early morning <br />customers. Spryo Mitrokostas, owner of the complex, said they were allowing for <br />stacking of three cars. Mr. Kirrane suggested that the Board may want to have a review <br />period or have a condition that there be no stacking beyond a certain point. Mr. <br />Mitrokostas said that the DPW director also had the power to close the window if traffic <br />was a problem. Mr. Govoni said that the Board could put a time limit on the permit to <br />require a review. Mr. Govoni moved to continue the hearing to September 27, 1995. Mr. <br />Nelson seconded. Spohr -Requests a Variance from Sections 174-31, 174-32 and 174-33 of the <br />Zoning By-laws for permission to vary the setback requirements and to construct a single <br />family dwelling on an unpaved road in an R-3 zoning district on property located at 29 <br />Hamblin Road (Map 120, Block 32) Mashpee, MA (Owner of record: Elizabeth B. <br />Spohr). <br />Mr. Govoni stepped down from the Board for this hearing. <br />• Members sitting: I Regan, K. Marsters, C. Hawver <br />Attorney Kevin M. Kirrane represented the applicant and reviewed plans for the <br />constructions of a single family home on a gravel way. He showed photographs of the <br />street and explained that the topography of the lot prevented placement of the house in <br />any other location. He explained that the owner has permission from the Board of Health <br />to locate the septic system on a lot directly across the street since the subject lot is <br />impacted by wetlands. The Board was informed that the lot was created before zoning <br />and that most of the roads are unimproved gravel ways. Comments were received from <br />abutters concerning the location of the house on the lot. No comments were received <br />from the Fire Dept. <br />Mr. Marsters moved to grant a Variance of 3 feet to allow construction of a single family <br />house on an unpaved road 47 feet from wetlands and allow for a 16 foot front setback. <br />Ms. Hawver seconded.
