Board of Appeals Minutes September 13, 1995 3. <br />• J Patrick Riley Jr. - Has Appealed the Decision of the Building Inspector denying a <br />building permit for a single family dwelling in an R-5 zoning district on property located at <br />26 Shorewood Drive (Map 58, Block 36) Mashpee, MA. The denial was based on the <br />determination of the Building Inspector that the plans did not meet the setbacks. <br />Members sitting: E. Govoni, C. Hawver, R Nelson <br />Mr. Riley explained that the Building Inspector had refused a Building Permit. He noted <br />that the lot is impacted by wetlands and the house had to be placed within 20 feet of the <br />street. Mr. Govoni noted that the lot was created in 1963 and the zoning required a 20 <br />foot front setback and 7.5' side setback and 75' frontage. Mr. Govoni noted that a <br />Variance was not required and moved to overturn the decision of the Building Inspector. <br />Ms. Hawver seconded. All agreed. <br />John J. Trotto - Requests a Variance from Section 174-25.I.9 of the Zoning By-laws for <br />permission to exceed 70' for the length of a pier on property located in an R-3 zoning <br />district at 58 Quaker Run Road (Map 90, Block 47) Mashpee, MA. <br />John J. Trotto - Requests a Special Permit under Section 174-25.I.9 of the Zoning By- <br />laws for a 130' pier, ramp and float in Shoestring Bay on property located in an R-3 <br />zoning district at 58 Quaker Run Road (Map 90, Block 47) Mashpee, MA. <br />• Mr. Govoni stepped down for this Hearing. <br />Members sitting: R. Nelson, K. Marsters, C. Hawver <br />Engineer John Hunter represented Mr. Trotto and said the shallowness of the water <br />required the extra length. He said the dock would be used for a 17' Whaler. Don Dyer, a <br />direct abutter, stated that the Locus on the plans is incorrect. He said the proposed <br />location is in a narrow cove and the dock would be in front of his house and would <br />interfere with navigation of his sailboat. Mr. Hunter said other docks in the area are in 2' <br />of water. Mr. Regan said he had a comment from the Harbormaster who objected to the <br />length of the dock and recommended a 70' dock. <br />Mr. Nelson moved to continue the hearing to September 27, 1995. Ms. Hawver <br />seconded. All agreed. <br />0 <br />
