• TOWN OF MASHPEE <br />Board of Appeals <br />Minutes of September 27, 1995 <br />The Mashpee Board of Appeals held a meeting on Wednesday, <br />September 27, 1995 at 7:30 p.m. at the Mashpee Town Hall. <br />Members present: E. Govoni, C. Hawver, K. Marsters, R. Nelson <br />Members absent: <br />J. <br />Regan, <br />J. Friel <br />Also present: <br />W. <br />Hauck, <br />Building Inspector <br />John J. Trotto - Requests a Variance from Section 174-25.I.9 <br />of the Zoning By-laws for permission to exceed 70' for the length <br />of a pier on property located in an R-3 zoning district at 58 <br />Quaker Run Road (Map 90, Block 47) Mashpee, MA. <br />Members sitting: C. Hawver, K. Marsters, B. Nelson <br />This was continued from September 13, 1995. Mr. Trotto nor <br />anyone else was present to represent him. Mr. Hauck stated <br />there was no action taken by Mr. Trotto with any of the other <br />Boards. Ms. Hawver stated no other information has been <br />• received. Mr. Nelson stated that Mr. Trotto failed to establish <br />any justification for the Variance, and there are two other <br />piers in the area that do not have this length. Mr. Nelson <br />further stated there was testimony that it would effect a <br />sailboat trying to tack, and he feels Mr. Trotto did not create <br />a situation whereby he is entitled to a Variance. Mr. Marsters <br />agreed with Mr. Nelson and stated that there was correspondence <br />from the Harbormaster against the Variance for safety reasons <br />and concern for boaters. Ms. Hawver agreed and stated that <br />Mr. Trotto did not contact the Harbormaster and resolve this. <br />Mr. Marsters further stated that Mr. Trotto requested the Board <br />to be here tonight, and he was to have taken some action. <br />Mr. Marsters moved to deny the Special Variance without <br />prejudice. Mr. Nelson seconded. All agreed. <br />John J. Trotto - Requests a Special Permit under Section 174- <br />25.I.9 of the Zoning By-laws for a 130' pier, ramp and float <br />in Shoestring Bay on property located in an R-3 zoning district <br />at 58 Quaker Run Road (Map 90, Block 47) Mashpee, MA. <br />Members sitting: C. Hawver, K. Marsters, B. Nelson <br />Mr. Marsters moved to deny the Special Permit without prejudice. <br />Mr. Nelson seconded. All agreed. <br />• <br />
