The applicant is applying under Sections <br />174-25.E.2 and 174-25.H.6 to allow an accessory drive-through <br />window to be used in connection with the existing donut/pastry <br />eating place on property located in a C-2 zoning district on <br />property located on Route 151 and Ninigret Avenue (Map 72, Blocks <br />57 and 58) Mashpee, MA. Members sitting: E. Govoni, K. Marsters, R. Nelson. <br />Attorney Kevin Kirrane and Constantino Mitrokostas of John's <br />Pond Realty represented the applicant. Mr. Govoni stated this <br />went through Design Review for the placement of signs and <br />maintenance of the buffer zone on the rear of the property which <br />is residential. The plan will be modified to show an undisturbed <br />buffer. Mr. Govoni suggested adding a sign "Keep Left" next <br />to the "Enter" sign. They increased the opening to 44 feet <br />from 30 feet, allowing three lanes of traffic. Mr. Govoni would <br />like to keep the parking spaces parallel and limit stacking <br />so the driveway area remains open. Mr. Mitrokostas suggested <br />putting a sign "Do Not Block Driveway." Mr. Kirrane asked if <br />the Board would want to make a determination on the number of <br />parking spaces based on a conversation he had with Mr. Taylor <br />(DPW) who wanted to see a limitation. Mr. Nelson expressed <br />concern about the approach to the stacking lane and the hazard <br />of on -coming vehicles crossing paths. Mr. Mitrokostas stated <br />. that traffic could be diverted behind the building if it became <br />a problem. Mr. Govoni stated that this is why Mr. Taylor <br />suggested having three lanes, and why he would recommend putting <br />a condition on this for one year. Mr. Nelson noted that <br />primarily those using the complex will most likely be the ones <br />to have complaints, and they will have to be resolved by the <br />complex. Mr. Mitrokostas pointed out that 80% of the business <br />is done between the hours of 6:00 a.m. and 10:00 a.m. <br />Mr. Govoni moved to grant the Modification of the Special Permit <br />with the following conditions: (1) To abide by the request <br />of the Design Review Committee and submit a plan showing where <br />the undisturbed areas would be to the rear of the building per <br />their request; (2) A marker be put at the indicated spot <br />parallel to the parking on the side of the building to show <br />the point where no standing beyond this point is allowed so <br />as to limit stacking of vehicles in the drive; (3) The drive <br />entrance be open 30 to 44' feet; and (4) At the end of one year <br />as of this date (or before if applicant desires), to review <br />any problems that might occur and/or modification(s) that need <br />to be made.
